Silver State Lottery – Terms & Conditions

Welcome to Silver State Lottery (“Company,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your access to and use of the Silver State Lottery website, platform, or any associated services (collectively, the “Services”). By creating an account, purchasing lottery tickets, or otherwise using our Services, you agree to be legally bound by these Terms.
1. Definitions
“User,” “You,” or “Your” refers to any individual creating an account, purchasing lottery tickets, or otherwise interacting with the Services.
“KYC” (Know Your Customer) refers to our identity verification procedures required by law and internal policy.
“Nevada Law” refers to the statutes and regulations of the State of Nevada, including but not limited to NRS Chapters 462, 465, and 205.
“Chargeback Fraud” means initiating a payment reversal (chargeback) without valid grounds, especially after receiving goods or services.
2. Eligibility & Compliance
Age Requirement: You must be at least 18 years old to register for or participate in any Silver State Lottery activity. Any violation of this age requirement will result in immediate account termination and potential referral to law enforcement.
Physical Location: To purchase lottery tickets, you must be physically located within the State of Nevada at the time of purchase. We use IP addresses, device data, and geolocation services to verify your location.
KYC Verification: You agree to undergo identity verification processes, which may include submitting government-issued identification and proof of address. Failure to complete KYC may result in denial of access to certain Services or forfeiture of winnings.
Prohibited Use of VPN/Proxy: Using a VPN, proxy server, or any tool to disguise your actual location is strictly prohibited. Violation will lead to immediate account suspension and any associated winnings may be voided.
3. No Refund Policy
All Sales Final: No refunds, returns, or exchanges are provided under any circumstances. Once your payment is processed, it is considered final.
Chargeback Prohibition: Any attempt to dispute or reverse a valid charge (e.g., a credit card chargeback) will be treated as Chargeback Fraud. We reserve the right to pursue legal and civil remedies to recover funds, fees, and damages.
4. Purchasing & Payment Methods
Accepted Methods: We accept payments via:
Major Credit Cards/Debit Cards
Electronic Bank Transfers (where supported)
Select Cryptocurrencies (e.g., Bitcoin, Ethereum)
Transaction Finality: Your ticket purchase is not confirmed until your payment is fully processed. This includes final blockchain confirmations for cryptocurrency transactions.
Fraudulent Transactions: We reserve the right to cancel, suspend, or investigate any transaction that appears suspicious, violates these Terms, or potentially violates federal or Nevada law.
5. Drawings, Winnings & Payouts
Draw Schedule: Specific draw times and frequency are determined by Silver State Lottery and may be changed at our discretion.
Winner Notification: Winners are announced via the user dashboard and email/SMS notifications. It is your responsibility to maintain valid contact information.
Claiming Prizes:
KYC Must Be Complete. You must complete any required identity verification before claiming prizes.
Timeframe. Prizes must be claimed within the published timeframe. Unclaimed prizes are forfeited.
Withdrawal Requests: All withdrawals (i.e., prize payouts) are manually reviewed. Processing typically takes 7–14 business days, but may be delayed due to compliance requirements or other factors.
Tax Obligations: Lottery winnings are generally subject to federal income tax (and possibly state taxes). You are solely responsible for reporting and paying any applicable taxes. Silver State Lottery may issue IRS Form W-2G or other tax forms as required by law.
6. Location Verification & Geolocation
IP Tracking: We collect and store IP addresses for every click, login, and purchase. This data is used to verify compliance with location requirements and detect potential fraud.
Location Spoofing: Any attempt to falsify your location (via VPN, proxy, or other means) constitutes a material breach of these Terms.
Consequences of Violation: If we discover location misrepresentation, we may cancel transactions, terminate your account, and report illicit activity to law enforcement.
7. Fraud Prevention & Legal Enforcement
Zero Tolerance: We maintain a strict zero-tolerance policy for fraudulent behavior, including identity theft, chargeback fraud, or submitting false information.
Applicable Laws:
Nevada Revised Statutes (NRS):
NRS 462 & 465 – Governing lottery and gaming fraud.
NRS 205.0832 – Prohibiting obtaining money by false pretenses.
Federal Statutes:
Mail & Wire Fraud (18 U.S.C. §§ 1341, 1343).
Violations may result in felony charges, substantial fines, and/or imprisonment.
Civil & Criminal Action: We reserve the right to seek damages (including legal fees) through civil litigation and to refer cases to state or federal law enforcement for criminal prosecution.
Account Termination: We may suspend or permanently terminate accounts involved in suspected or confirmed fraud without prior notice or liability.
8. Account Management & Security
Account Responsibility: You are responsible for maintaining the confidentiality of your login credentials. Any activity on your account is presumed authorized by you.
Account Updates: You must promptly update any changes to your personal or contact information in your profile settings.
Multiple Accounts: You may not create multiple accounts or attempt to circumvent daily/weekly ticket limits. Violations may result in consolidated account closure or permanent bans.
9. Data Privacy & Security
Data Collection: We collect personal data (e.g., name, address, IP logs) to comply with gaming regulations and to prevent fraud.
Data Usage: We do not sell or rent your personal information. Data is used solely for legal compliance, transaction fulfillment, and customer support.
Storage & Security: We utilize industry-standard encryption and secure servers. However, we cannot guarantee absolute security against all cyber threats.
Right to Deactivate: Due to regulatory requirements (e.g., anti-money laundering audits), we may be unable to fully delete your account and transaction records. Instead, we will deactivate your account upon request.
10. Dispute Resolution
Binding Arbitration: You agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services shall be settled by binding arbitration administered by a recognized arbitration body in Nevada.
Class Action Waiver: You waive any right to participate in a class action lawsuit or class-wide arbitration against Silver State Lottery.
Governing Law & Venue: These Terms are governed by and construed under Nevada law, without regard to conflicts of law principles. The exclusive venue for any legal proceeding not subject to arbitration is [insert local county], Nevada.
11. Limitations of Liability
No Warranties: We provide the Services on an “AS IS” and “AS AVAILABLE” basis. We disclaim any express or implied warranties, including but not limited to merchantability and fitness for a particular purpose.
Indirect Damages: In no event shall Silver State Lottery be liable for indirect, incidental, or consequential damages, including lost profits or data.
Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control, including acts of God, natural disasters, or governmental actions.
12. Changes to Terms
Periodic Updates: We may modify these Terms at any time by posting the updated version on our website.
Acceptance of Changes: Continuing to use the Services after changes are posted indicates acceptance of the revised Terms.
13. Severability & Entire Agreement
Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in effect.
Entire Agreement: These Terms, along with our Privacy Policy and Fraud Prevention & No Refunds Policy, constitute the entire agreement between you and Silver State Lottery.
